Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the services provided by Shrike Security Inc ("Shrike", "we", "us") — including the Shrike platform at shrikesecurity.com, the scan API, the MCP server, the SDKs, the LLM Gateway, and related software and documentation (together, the "Services"). By creating an account, installing our software, or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to it.

Enterprise customers with a signed order form or master services agreement are governed by that agreement where it conflicts with these Terms.

2. The Services

Shrike provides runtime governance for AI systems: content and action evaluation against configurable policy, with results returned to your applications. Detection quality is probabilistic by nature — no security product identifies every threat, and Shrike does not guarantee that all unsafe content or actions will be detected or blocked, or that safe content will never be flagged. You remain responsible for the configuration of your policies, the conduct of your AI systems, and your own compliance obligations.

Open-source client components (SDKs, MCP server) are licensed separately under the Apache License 2.0; these Terms govern the hosted Services those clients connect to.

3. Accounts and API Keys

You are responsible for safeguarding your account credentials and API keys and for all activity under them. Notify us promptly at security@shrikesecurity.com if you believe a key has been compromised; keys can be rotated from the dashboard.

4. Acceptable Use

You agree not to:

(a) use the Services to build or operate systems that violate applicable law; (b) attempt to probe, disable, or circumvent the Services' security or rate limits, except through our coordinated vulnerability disclosure process; (c) resell or provide the Services to third parties as your own offering without an agreement with us; (d) use the Services to develop a competing product by systematically extracting detection behavior; or (e) exceed the usage limits of your tier. Security research conducted responsibly against your own account and disclosed to security@shrikesecurity.com is welcome.

5. Your Data

You retain all rights to the content you submit for scanning. We process it to provide the Services as described in our Privacy Policy: by default, safe interactions are retained as a cryptographic hash plus metadata rather than original content, and scan records are encrypted at rest. We do not train detection models on your scanned content. Data processing agreements are available for Enterprise customers.

6. Fees and Tiers

Paid tiers are billed as described at purchase (directly or through a cloud marketplace). Fees are non-refundable except where required by law or expressly agreed. We may change pricing with notice effective at your next renewal. The free tier is provided as-is and its limits may change.

7. Intellectual Property

We retain all rights in the Services, including the detection pipeline, models, and documentation. You receive a limited, non-exclusive, non-transferable right to use the Services during your subscription. Feedback you provide may be used to improve the Services without obligation to you.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. USE OF THE SERVICES DOES NOT ITSELF CONSTITUTE OR GUARANTEE COMPLIANCE WITH ANY LAW, REGULATION, OR CERTIFICATION FRAMEWORK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, AND OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (OR US$100 IF YOU USE ONLY THE FREE TIER). THESE LIMITS DO NOT APPLY TO YOUR BREACH OF SECTION 4 OR EITHER PARTY'S INFRINGEMENT OF THE OTHER'S INTELLECTUAL PROPERTY.

10. Termination

You may stop using the Services at any time. We may suspend or terminate accounts that breach these Terms, with notice where practicable. On termination, your right to use the Services ends; provisions that by nature survive (Sections 5, 7, 8, 9, 11) survive.

11. General

These Terms are governed by the laws of the State of Texas, excluding conflict-of-law rules, and disputes will be resolved in the state or federal courts of Dallas County, Texas. We may update these Terms; material changes will be notified via the dashboard or email, and continued use after the effective date constitutes acceptance. If any provision is unenforceable, the rest remain in effect.
